CONFIRMED REGULATORY POSITION — Lagos State’s Physical Planning Permit Authority says planning permits are required for building projects, and its 2026 enforcement notices reiterate that permit and planning compliance form the basis of enforcement. Title ownership therefore answers who holds an interest in land; it does not establish what may lawfully be built on it.

CONFIRMED BUILDING-CONTROL REQUIREMENTS — Lagos building-control regulations require a planning permit before commencement authorization. Depending on the project, the commencement file can include approved architectural, structural, mechanical and electrical designs, professional supervision, programme of works, safety documentation, insurance, and—above four floors or on low-bearing soils—a subsoil investigation. Construction stages are subject to inspection and certification, and completed buildings require a Certificate of Completion and Fitness for Habitation.

BLUEGATE ANALYSIS — A residential feasibility study should begin before glossy design. Confirm plot dimensions and access; allowable use, density, height and setbacks; parking and circulation; geotechnical conditions; infrastructure and service costs; professional and statutory fees; buildable saleable area; achievable pricing; absorption period; and finance cost. Each constraint changes the number of units and therefore changes the land value and JV sharing formula.

JV CONTROL — Landowner and developer should not negotiate percentages from headline land value alone. First agree the approvable scheme, responsibility for approvals and professional studies, verified development budget, funding proof, milestone timetable, sales or letting strategy, reporting rights, default remedies, completion security and treatment of cost overruns. The sharing ratio comes after the model—not before it.

RED-FLAG TEST — Pause where a proposal promises a specific number of apartments before planning checks; relies on unusually high prices or rapid presales; excludes finance, infrastructure or statutory costs; or assumes every square metre can become saleable space. A project can be attractive on paper and still be unfinanceable, unapprovable or operationally weak.

BLUEGATE POSITION — For BlueGate, verification of a development or JV opportunity must connect title diligence to planning feasibility, construction control and a conservative commercial model. Only then should the opportunity enter the partner or client pipeline.
